Background To the Regulations

The Regulations came into place in May 2012 to ensure that valuable recyclable resources can be collected, recovered and recycled, diverting them from a costly landfill.

Zero Waste Obligations

UK business must comply with the flowing legal requirements:

  • Separate waste metal - plastic - glass - paper and card for collection by January 2014
  • Food companies that generate more than 50kg of food waste per week are required to separate food waste for collection and recovery from January 2014. For businesses that generate over 5kg of food waste the separate collection of food waste is required by January 2016
  • Local Authorities are required to provide a minimum level of recycling services to encourage a high level of separate collection and improve the quality of recycled material.
  • A landfill and incineration ban on separately collected waste materials including food - metal - plastic - glass - paper and card
  • Requiring waste contractors to provide services which deliver a high quality recycled material
  • Metals and dense plastics should be removed by operators prior to Incineration
  • Landfill ban on biodegradable municipal waste from January 2021.

What are the penalties for Non- Compliance?

Any company failing to comply with the requirements without reasonable cause will be liable to:

  • On summary conviction a fine not exceeding £10000
  • On conviction on indictment to an unlimited fine

NB there is no provision for issuing a fixed penalty notice in respect of the Waste (Scotland) Regulations 2012.
